The short answer

The DPDT keeps a Design Register that lists registered designs and their details in order of registration (Section 17(1)). Anyone can inspect it and obtain extracts, and it must be open to the public at convenient times and places (Section 17(2)). A certified copy of an entry, with the DPDT seal, is available on payment of the fee and is accepted as prima facie evidence in all legal proceedings that the entry exists (Sections 17(3) and 18). Anyone can also apply for a design search on the prescribed form with the fee (Section 33), and can get information and a certified copy of an application (Section 7(7)).

The Design Register

  • The register contains the registered designs and related information, in the order they were registered (Section 17(1)).
  • Any person can inspect it and obtain extracts under the Act and the Rules (Section 17(2)).
  • Renewals, assignments and licences are recorded in it (Sections 15(3), 19 and 20).
  • A certified copy or extract, with the DPDT seal and on payment of the fee, can be supplied (Section 17(3)).

Using certified copies

A certified copy of an entry in the register is prima facie evidence that the entry exists in all legal proceedings (Section 18). Owners use it to support infringement complaints and injunction applications. See interim injunctions.
