The short answer

An Argentine trademark lasts 10 years and can be renewed indefinitely, but only if the mark was used in the 5 years before each expiry, shown by a sworn statement. After publication, anyone can oppose within 30 calendar days. A mark can be declared lapsed for goods or services not used in Argentina in the 5 years before the request. Between the end of the 5th and the end of the 6th year after grant the owner must file a sworn statement of use.

Trademark deadlines in Argentina at a glance

These rules come from Law No. 22,362 on Marks and Designations, in the updated text published by the Argentine government (translated here from Spanish). The authority is the National Institute of Industrial Property (INPI). A 2025 INPI resolution also changed what the INPI examines on its own, which we describe below. We re-check each deadline against the live text before we file.

QuestionAnswer
How long does a trademark last?10 years, renewable indefinitely for equal periods (Article 5).
Which date does the term count from? The law fixes the term at 10 years and does not state a separate start date in the articles we read. We diarise from the date of grant shown on your certificate and check the INPI record for the exact expiry date.
When can I renew?File the renewal with a sworn statement of use for the period required by Article 5 (Article 20). Renewal requires that the mark was used in the 5 years before each expiry, in trade for a product or service or as part of the name of an activity (Article 5).
Opposition period30 calendar days from publication, filed electronically with the INPI with the opponent's name, domicile and grounds (Articles 13 and 14). The INPI resolves oppositions that remain after 3 months from notification (Article 16), and the ruling can be appealed within 30 business days (Article 17).
Priority claimConvention priority is available. We confirm the form and the period in the regulations at filing.
Non-useThe INPI declares lapse, on its own initiative or on request, for products or services not used in Argentina in the 5 years before the request, unless force majeure applies. Use for related goods or services can prevent lapse. After the 5th year from grant and before the end of the 6th year, the owner must file a sworn statement of use (Article 26).
AssignmentA transfer is valid against third parties once it is recorded with the INPI (Article 6). The assignment or sale of a business includes its mark unless agreed otherwise (Article 7).
NullityThe action for nullity expires 10 years after the registration (Article 25).
2025 change in examinationINPI Resolution 583/2025 limits the INPI's own examination of new applications to absolute grounds and public-order issues. Some relative grounds, including conflicts with earlier rights, are assessed only if a third party raises them (Infoleg note).

Who can register a trademark in Argentina

Individuals and companies from any country can apply to the INPI. Because of the 2025 change, the INPI examines absolute grounds itself, so owners of earlier marks must be ready to oppose within the 30-day period after publication.

Representation. An application must state the applicant's real domicile and a special electronic domicile (Article 10). A special domicile chosen by a person living abroad is valid for jurisdiction and notifications (Article 11). Foreign owners normally act through an Argentine agent, and we confirm the current requirements before filing.
