A Costa Rican trademark registration expires 10 years from the date of grant and can be renewed indefinitely for 10-year periods. File the renewal request in the year before expiry, or within a 6-month grace period after it with a surcharge. Anyone can oppose within 2 months of the first publication. A mark can be cancelled for 5 years of non-use. A foreign applicant without a domicile or real establishment in Costa Rica must name a local attorney.

These rules come from Law No. 7978 of 6 January 2000 on Trademarks and Other Distinctive Signs, in the Spanish text published by the University of Alicante IP portal. Law No. 8632 of 2008 amended other articles (1, 3, 8 to 10, 18, 25, 35, 44, 74 to 82) but not the ones used here, and we confirm later changes and fees before we file.

| Which date does the term count from? | The date of grant (concesión) of the registration (Article 20). |
| When can I renew? | The renewal request is filed with the Registry within the year before the expiry date. It can refer to only one registration. The Registry records the renewal without examination or publication (Article 21). |
| Is there a grace period? | Yes. The request can also be filed within a grace period of 6 months after expiry with a surcharge on top of the renewal fee. During the grace period the registration keeps its full validity, and the renewal takes effect from the old expiry date (Article 21). |
| Opposition period | Any interested person can oppose within 2 months of the first publication of the notice announcing the application, with the facts, the law and the evidence. If evidence is not attached, it can follow within 30 calendar days. The applicant has 2 months to answer (Article 16). |

| Priority claim | The Law has no separate priority period in the articles we reviewed. Costa Rica is a Paris Convention member, so the 6-month priority applies through the treaty. We confirm the Registry's requirements for the claim. |
| Non-use | On request by any interested person, after hearing the owner, the Registry cancels a registration if the mark has not been used in Costa Rica during the 5 years before the cancellation action. No request can be made before 5 years from registration. Use that starts after 5 years only helps if it began at least 3 months before the request (Article 39). |
| Assignment | A mark, registered or pending, can be transferred by act between living persons or on death. The transfer must be in writing and recorded to affect third parties (Article 31). Changes of the owner's name are recorded under Article 32. |
