The short answer
A Georgian trademark registration is valid for 10 years from the date of registration at Sakpatenti and can be extended indefinitely for 10-year periods. File the extension request and pay the fee in the final year, or pay within 6 months after expiry, after which the registration is cancelled without reinstatement. After the application data are published, an interested party can bring an action before the Chamber of Appeals within 3 months. A mark can be cancelled after 5 years without use in Georgia.
Trademark deadlines in Georgia at a glance
These rules come from the Law of Georgia No. 1795-IIS of 5 February 1999 on Trademarks, in the English text on WIPO Lex as amended up to Law No. 1922 of 12 December 2017. WIPO Lex lists a later amendment (Law No. 4048 of 21 February 2024), so we check the latest text before we file. The authority is Sakpatenti.
| Question | Answer |
|---|---|
| How long does a trademark last? | 10 years, extendable indefinitely by consecutive periods of 10 years (Article 20). |
| Which date does the term count from? | The date of registration of the trademark at Sakpatenti (Article 20(1)). This is later than the filing date, so diarise from the date on your certificate. |
| When can I renew? | File the extension request and pay the fee during the final year of validity (Article 20(2)). |
| Is there a grace period? | Yes. The holder may pay the fee within 6 months from the expiry. If that deadline is missed, the registration is cancelled from the date of expiry without the right of reinstatement (Article 20(4)). |
| Opposition period | Within 3 months from the publication of the application data in the Bulletin, any interested party can bring an action before the Chamber of Appeals against the registration decision, only on the grounds that Article 4 or 5 was violated (Article 16(4)). |
| Reply to an office action | The applicant can appeal a refusal at the Chamber of Appeals within 3 months of the decision, and the Chamber hears the appeal within 3 months (Article 16(1), (2) and (5)). |
| Priority claim | Convention priority under Article 4 of the Paris Convention, and exhibition priority under Article 11, are recognised in the Law (definitions). |
| Non-use | A registration can be cancelled if the mark has not been used continuously during 5 years for the goods it is registered for in Georgia. If use started or resumed between the end of the 5 years and the filing of the cancellation request, nobody can seek cancellation. Non-use caused by circumstances beyond the holder's will, such as import restrictions, does not count (Article 27). |
| Assignment | Record changes of ownership in the Register so the register and the certificate are updated (Article 19). Ask us for the current procedure and fee. |

Under Article 27, a trademark registration can be cancelled if the mark has not been used continuously during 5 years for the registered goods in Georgia, if it became a generic term, or if the holder's use misleads consumers. Use resumed before the cancellation request protects the mark, and circumstances independent of the holder's will are not counted as non-use.
Keep dated proof of use in Georgia: invoices, packaging, advertising and website pages that show the mark with the goods or services.
