The short answer
An Irish trade mark is registered for 10 years from the date of registration, which is the filing date, and can be renewed indefinitely for further 10-year periods. Renew before expiry, or within 6 months after expiry with an additional fee. Notice of opposition must reach the Controller within 3 months of publication. A mark can be revoked after 5 years of non-use. Every proprietor needs an address for service in the European Economic Area.

Until the application is made, the transaction is ineffective against a person who acquires a conflicting interest in ignorance of it (Section 29). |
