The short answer

A trademark representative in Bangladesh must be a Bangladesh citizen and permanent resident with the principal place of business in Bangladesh, hold a degree and have at least 2 years of experience or IP training (or 2 years of work in the Registry), and pass the Registrar's check of knowledge (Rules 59 and 60). Registration is on Form TM-2 and must be renewed every year on Form TM-3 by 31 December; a late renewal is possible until 31 March with a late fee. Your appointed agent files Form TM-10 with your application (Rules 6 and 8).

Yearly renewal of the representative's registration

StepDeadline
Annual renewal on Form TM-3 with the feeBy 31 December
Late renewal on Form TM-3 with a late feeBy 31 March of the following year

A representative who does not renew in time risks losing the right to act. Ask any firm that files for you to confirm that its representatives are currently registered.

What the agent does in your application

  • Files Form TM-10 together with Form TM-1. A party outside Bangladesh must give an address for service in Bangladesh on TM-10 (Rules 6, 8 and 13).
  • Receives the Registrar's objection notices and the Trademark Journal entries for your mark.
  • Files replies, hearing requests and evidence within the Rules' deadlines (see Rules 2015 deadlines and forms).
  • Signs powers of attorney. See the power of attorney rules.

How to choose your Bangladesh agent

  • Ask who will actually act for you in Bangladesh, not only who takes your instruction.
  • Ask for a written status report from the DPDT record, not a forwarded message.
  • Check that the firm tracks the Journal and your deadlines. Missing a reply deadline means the application is treated as abandoned.
  • Compare official fees on our cost page; professional fees are separate.
