Patent Annuity in Bangladesh

A patent in Bangladesh remains valid for 20 years from the date of filing (or from the priority date if applicable).
However, this 20-year protection is conditional upon the payment of annual renewal (annuity) fees.

🔁 When Do You Start Paying Renewal Fees?

• You don’t need to pay any renewal fee for the first five years.
• The first renewal fee is due before the end of the 5th year, to cover the 6th year.
• From the 6th year onward, you must pay every year before the start of the next year.

⏳ Missed the Deadline? Here’s the Grace Period

If you miss the renewal deadline, you still get a 3-month grace period.
However, to maintain your patent rights:

• You must pay the renewal fee, plus a surcharge (late fee) within this 3-month period.
• If you don’t pay within this time, the patent will lapse.

⚠️ What Happens If You Don’t Pay?

Failure to pay the renewal fee within the deadline and the grace period results in:

• Cancellation of the patent.
• Loss of all legal rights associated with the invention.
• Your patent becomes invalid, and you no longer have exclusive rights to use or license the invention.

🔄 Can a Cancelled Patent Be Restored?

Yes—but under strict conditions:

• You must apply for restoration within 2 years from the date of cancellation.
• You must justify the delay by showing valid reasons for missing the payment.
• The Director General must be satisfied with your explanation.
• You must pay:
  • The pending renewal fees
  • The restoration fee

If approved, your patent will be revived and you can resume enjoying your rights.
