Once registered, an industrial design in Bangladesh enjoys protection for a fixed period. However, to maintain this protection, timely renewals are necessary. Section 15 of the new Act outlines the duration, renewal procedure, and consequences of non-renewal.


🔒 Initial Term of Protection

  • The initial validity of a registered design is 10 years from the date of filing the application or from the date the right is granted (in the case of deferred registration).

🔁 Renewal Options

  • The design can be renewed up to 3 times, each for a 5-year term.
  • Thus, the maximum duration of protection is 25 years.

📝 Renewal Procedure

To renew a design, the following conditions must be met:

  1. Renewal Application must be filed before the expiry of the current term.
  2. The applicant must pay the prescribed renewal fee using the specified form and method.
  3. A grace period of 6 months is allowed after expiry, but this requires an additional late fee.

❌ Failure to Renew

  • If renewal is not filed within the permitted time, including the grace period, the registration will be cancelled.
  • Once cancelled, the design will be removed from the official register, and protection ends.
