
Once registered, an industrial design in Bangladesh enjoys protection for a fixed period. However, to maintain this protection, timely renewals are necessary. Section 15 of the new Act outlines the duration, renewal procedure, and consequences of non-renewal.
🔒 Initial Term of Protection
- The initial validity of a registered design is 10 years from the date of filing the application or from the date the right is granted (in the case of deferred registration).
🔁 Renewal Options
- The design can be renewed up to 3 times, each for a 5-year term.
- Thus, the maximum duration of protection is 25 years.
📝 Renewal Procedure
To renew a design, the following conditions must be met:
- Renewal Application must be filed before the expiry of the current term.
- The applicant must pay the prescribed renewal fee using the specified form and method.
- A grace period of 6 months is allowed after expiry, but this requires an additional late fee.
❌ Failure to Renew
- If renewal is not filed within the permitted time, including the grace period, the registration will be cancelled.
- Once cancelled, the design will be removed from the official register, and protection ends.
